1. Scope and contractual partner

These General Terms and Conditions apply to all orders placed by consumers or businesses through the GETOKEN online store at www.getoken.store.

The provider and contractual partner is GETOKEN, Kohlschütterstraße 1, 06114 Halle (Saale), Germany.

A consumer is any natural person who enters into a legal transaction primarily for purposes outside their trade, business or profession. Differing customer terms do not apply unless accepted in text form.

2. Products and product representations

GETOKEN sells clothing, accessories and related fashion products. Essential product characteristics are stated in the relevant product description, images, size guide and store information.

Colours, fit and product images may vary slightly because of screens, lighting and production. Customary or production-related deviations are not defects where reasonable and where no expressly agreed characteristic is affected.

Many products are produced only after the order is received. Production after ordering alone does not mean that the product is individually personalised.

3. Ordering process and contract formation

Product presentation in the online store is an invitation to place an order, not a binding offer. Customers can review and correct products, quantities, variants, delivery address and other information before submitting the order.

By clicking the final order button, the customer submits a binding order. The purchase contract is concluded when GETOKEN accepts the order by sending an order confirmation by email.

GETOKEN may reject or cancel orders in cases such as fraud suspicion, misuse, stolen payment methods, unlawful activity, permanent unavailability or obvious typographical, calculation or pricing errors. Payments already received will be refunded using the original payment method.

4. Contract language and storage

The contract language is English. A German translation may be provided. If the English and German versions conflict, the English version generally prevails, without limiting mandatory consumer rights.

Order information is stored as required by statutory retention duties and for performance of the contract. The customer receives order confirmation by email and may save or print the terms and order information.

5. Prices, currencies, shipping and payment

Prices are total prices in the currency shown. Taxes, tax treatment and shipping costs are displayed during checkout before the binding order is submitted.

Available payment methods are displayed during checkout and may include card payments, digital wallets, PayPal, Shopify Payments, Klarna or local payment methods. There is no entitlement to a specific method.

The purchase price is due immediately upon conclusion of the contract unless otherwise stated. External payment-provider terms and privacy policies may apply.

6. Production, availability and changes

Products may be produced specifically after an order is received. GETOKEN may use selected production, fulfilment, packaging and logistics partners while remaining the contractual partner.

Production generally begins after successful payment confirmation. Change requests must be sent immediately to info@getoken.store; implementation after order submission cannot be guaranteed.

If an ordered product becomes permanently unavailable after contract conclusion, GETOKEN may withdraw from the contract and refund payments received without undue delay. A replacement product is supplied only with express customer agreement.

7. Delivery, customs and transfer of risk

Delivery is available to countries and regions selectable during checkout. Estimated production and delivery times are estimates unless expressly stated as binding delivery dates.

Orders with several products may be delivered separately and at different times. The customer is responsible for a complete and correct delivery address.

Deliveries outside the European Union may be subject to import taxes, customs duties, handling charges or other official charges unless checkout expressly states that such charges are included.

For consumers, risk generally passes only when products are delivered to the consumer or designated recipient. For business customers, risk passes when products are handed to the shipping company.

8. Withdrawal and returns

Consumers generally have a statutory right of withdrawal for distance contracts. For ordinary purchases of goods, the withdrawal period is generally 14 days from the day the consumer or a designated third party receives the products.

Where products from one order are delivered separately, the period generally begins when the final product is received. The fact that a product is manufactured after ordering does not automatically exclude withdrawal.

The right of withdrawal may be excluded for products that are not prefabricated and are made according to an individual customer selection or specification, or are clearly personalised to the customer’s needs.

After a valid withdrawal, products must be returned within the statutory period to the return address provided by GETOKEN. The business address is not automatically the return address.

9. Defects, shipping damage and voluntary exchanges

Statutory rights relating to defective products apply. Customers should contact info@getoken.store as soon as possible if a product is damaged, incorrectly printed, defective or incorrectly delivered.

GETOKEN may request the order number, a problem description, photos of the product, detail photos of the defect and, where relevant, packaging or shipping-label photos to examine the issue faster.

There is no entitlement to a voluntary return or direct exchange beyond the statutory right of withdrawal unless GETOKEN expressly offers an additional return or exchange option.

10. Liability, accounts and customer duties

GETOKEN has unlimited liability for intentional misconduct, gross negligence, culpable injury to life, body or health, product-liability claims, fraudulently concealed defects, express guarantees and where unlimited liability is required by law.

For slightly negligent breach of an essential contractual obligation, liability is limited to typical and foreseeable damage. In all other cases, liability for slight negligence is excluded to the extent permitted by law.

Customers must provide truthful, complete and current information and must not use the online store for unlawful, fraudulent or abusive purposes.

11. Intellectual property and data protection

Product designs, logos, photographs, graphics, text, videos and other store content may be protected by copyright, trademark or other rights. Purchasing a product does not transfer rights in the underlying protected content.

Information about the processing of personal data is provided in the separate Privacy Policy.

12. Applicable law, venue and consumer dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only where it does not remove mandatory protections of the country of habitual residence.

For consumers, statutory venue rules apply. Where legally permissible for merchants, legal entities under public law or special public-law funds, Halle (Saale) is the place of jurisdiction.

GETOKEN is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board. Customers are asked to contact info@getoken.store first so a direct solution can be attempted.

13. Changes and final provisions

The version of these Terms available in the online store at the time of the order applies to that order. Changes do not apply retroactively to completed orders.

If individual provisions are or become invalid, the remaining provisions remain unaffected. Mandatory statutory rights, especially consumer, withdrawal and warranty rights, are not limited by these Terms.

Viele Produkte werden erst nach Eingang der Bestellung hergestellt. Änderungswünsche zu Größe, Farbe, Modell, Motiv oder Lieferanschrift müssen unverzüglich an info@getoken.store gesendet werden; eine Umsetzung nach Abgabe der Bestellung kann nicht garantiert werden.

Verbrauchern steht bei Fernabsatzverträgen grundsätzlich ein gesetzliches Widerrufsrecht zu. Die Widerrufsfrist beträgt bei gewöhnlichen Warenkäufen grundsätzlich vierzehn Tage ab Erhalt der Ware. Einzelheiten und Musterformular stehen auf der Seite Returns & Refunds.

Gesetzliche Gewährleistungsrechte bei mangelhaften, beschädigten, fehlerhaft bedruckten oder falsch gelieferten Produkten bleiben vollständig unberührt.

Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts, soweit zwingende Verbraucherschutzvorschriften nicht entgegenstehen. GETOKEN ist weder bereit noch verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
