This website is operated by GETOKEN ("GETOKEN," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, storefront, and any related online services (collectively, the "Service").

Please read these Terms carefully. They contain important information regarding your legal rights, remedies, and obligations, including limitations and exclusions that may apply to you.

By accessing or using the Service, including by browsing products or placing an order, you acknowledge that you have read, understand, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

You may not use the Service or place an order if you (a) do not agree to these Terms, (b) are under 18 years of age, or (c) are prohibited from accessing or using the Service under applicable law.

By using the Service, you represent that you are purchasing products for personal or household use only, and not for unauthorized resale, bulk redistribution, or export where restricted.

We may modify these Terms at any time. Material changes will be effective after we post notice on the Service or otherwise provide notice as required by law. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. Review these Terms periodically.

GETOKEN offers apparel and related goods produced on a made-to-order, print-on-demand basis. Production typically begins after your order is placed and payment is authorized. Accordingly, production and shipping timelines may be longer than for ready-to-ship inventory.

Product images, colors, and descriptions are for illustration. Slight variations in print placement, color, fabric, or sizing may occur due to the manufacturing process and are not considered defects unless they materially depart from the listed product.

We may limit quantities, refuse orders, or discontinue products at any time, including due to availability, suspected fraud, or errors.

Your order constitutes an offer to purchase products under these Terms. All orders are subject to acceptance. We may refuse or cancel an order for reasons including suspected fraud, pricing errors, production constraints, or compliance concerns.

Prices are shown in the currency presented at checkout and may change without notice. In the event of a pricing error, we may cancel affected orders and issue a refund.

Payment is processed securely through Shopify and its payment providers. By submitting payment information, you authorize the charge for your order, including applicable taxes and shipping, and represent that your payment details are accurate and that you are authorized to use the payment method provided.

We arrange shipment to the address you provide at checkout. Estimated delivery dates are not guaranteed. Title and risk of loss pass to you upon delivery to the carrier or your receipt of the products, depending on applicable law.

Except where required by law, all sales are final. We do not accept returns or exchanges for change of mind, incorrect size selection, or buyer's remorse because items are made to order.

California residents may have the right to cancel an order within forty-eight (48) hours of placing it, provided the order has not entered production or shipped. Contact us promptly at support@getokenclothing.com to request cancellation.

If you receive a defective, misprinted, damaged, or incorrect item, notify us within fourteen (14) days of delivery confirmation with your order number and photos. We will review eligible claims and may offer a replacement or refund at our discretion. Misuse, normal wear, improper care, or alterations after delivery are not defects. By providing your email address or phone number at checkout, you consent to receive transactional communications about your orders, including confirmations, shipping updates, and customer support messages.

If you separately opt in to marketing communications, you may unsubscribe at any time using the link in our emails or by contacting us. Consent to marketing is not a condition of purchase.

All content on the Service — including designs, logos, product names, graphics, text, and images — is owned by or licensed to GETOKEN and protected by intellectual property laws. You receive a limited, non-transferable license to access the Service for personal shopping only. Unauthorized reproduction, scraping, or commercial use is prohibited.

You agree not to use the Service to violate law, infringe rights, interfere with security, use automated tools to access the Service without permission, introduce malware, or engage in fraudulent or abusive conduct. We may suspend or terminate access for violations.

The Service relies on third parties including Shopify (commerce and checkout), payment processors, shipping carriers, and print-on-demand fulfillment partners. We are not responsible for third-party outages, delays, or acts beyond our reasonable control, except as required by law or expressly stated in these Terms.

The Service and products are provided "as is" and "as available" to the maximum extent permitted by law. Except as expressly stated or required by applicable law, GETOKEN disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted or error-free operation of the Service. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

To the maximum extent permitted by law, GETOKEN shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from the Service or products, including loss of profits, data, or business interruption.

Except where prohibited by law, our total liability for any claim relating to a product or order shall not exceed the amount you paid for the specific order giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

Before initiating formal proceedings, contact us at support@getokenclothing.com with a written description of your dispute and order details. We will attempt to resolve the matter informally within thirty (30) days.

If informal resolution fails, any dispute arising out of these Terms or the Service shall be resolved through binding individual arbitration under the American Arbitration Association Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court if eligible. Class actions and representative proceedings are waived to the extent permitted by law.

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles, except where mandatory consumer protections in your jurisdiction provide otherwise.
